1. Introduction
Welcome to Tutors SA, a tutoring service provider operated by Vector Tutors Trading as Tutors SA, located in South Africa. By accessing our website (https://www.tutorssa.co.za/) and using our tutoring services, you agree to comply with these General Terms and Conditions.
2. Definitions
“Tutors SA” refers to the tutoring service operated by Vector Tutors.
“Tutor” refers to an individual providing tutoring services through Tutors SA and using the Tutors SA platform.
“Student” refers to an individual receiving tutoring services.
“Parent/Guardian” refers to the responsible party of a minor student.
3. Scope of Services
Tutors SA provides an online platform that facilitates the connection between tutors and students for academic support. Services may include individual or group tutoring, academic support, and related educational activities.
4. Registration and Account
Tutors must provide accurate and complete information during registration.
Tutors must submit academic credentials and undergo verification.
Tutors SA reserves the right to accept or reject applications at its discretion.
Tutors are responsible for maintaining the confidentiality of their accounts.
5. Tutor Responsibilities
Tutors must conduct themselves professionally and adhere to ethical teaching standards.
Tutors must provide accurate and truthful qualifications.
Tutors shall not engage in any form of misconduct, including harassment, discrimination, or fraud.
Tutors are independent contractors and not employees of Tutors SA.
6. Tutor and Student Responsibilities
Tutors SA provides tutoring services by matching students with qualified tutors. Both tutors and students/parents must ensure timely communication and adherence to agreed schedules.
7. Lesson Scheduling and Attendance
Lessons must be scheduled in advance and attended as agreed upon. Any changes or cancellations must be communicated within a reasonable timeframe.
8. Payment and Refund Policy
Payments for tutoring sessions must be made as per the agreed-upon payment schedule. Refunds will be considered in exceptional cases, subject to approval by Tutors SA. Refer to our Refund Policy for further details.
9. No-Show and Late Arrival Policy
If a tutor fails to attend a scheduled lesson without prior communication to both the client and Tutors SA, they may be penalized, and the client will not be charged for the missed session.
If a client (or learner) fails to attend a scheduled lesson without prior communication or arrangement with the tutor or Tutors SA, the lesson will be forfeited, and no refund will be provided.
If a client or learner arrives late to a lesson, the tutor is under no obligation to extend the session beyond the agreed end time to compensate for the lost time.
10. Student and Parent Responsibilities
Students and parents must ensure that tutoring sessions are conducted in a respectful and safe environment.
Payments must be made in accordance with agreed-upon terms.
Parents/Guardians of minors must supervise the tutoring arrangements and communications.
11. Fees and Payments
Fees for tutoring services shall be determined by Tutors SA and communicated to users.
Payments must be made in advance unless otherwise agreed.
Refunds may be issued at the discretion of Tutors SA in accordance with our refund policy.
12. Cancellations and Refunds
Cancellation of sessions must be made at least 24 hours in advance.
Refunds for cancellations are subject to Tutors SA’s refund policy.
Tutors SA reserves the right to cancel a session or terminate services if necessary.
13. Code of Conduct
All users of Tutors SA must:
Treat others with respect and professionalism.
Adhere to South African legal and educational regulations.
Refrain from sharing offensive, discriminatory, or misleading content.
14. Liability
Tutors SA acts as a facilitator and is not liable for any disputes, damages, or claims arising between tutors and students. Any issues should be reported promptly for resolution.
Tutors SA acts as an intermediary and does not guarantee specific educational outcomes.
Tutors SA shall not be liable for any loss, damages, or misconduct arising from interactions between tutors and students.
Users acknowledge that services are provided “as is” without warranties of any kind.
15. Data Protection and Privacy
Tutors SA collects and processes personal data in accordance with the Protection of Personal Information Act (POPIA) and our Privacy Policy.
Users consent to the collection, processing, and use of their data for service provision.
Tutors SA implements security measures to protect user data.
16. Intellectual Property
All content on the Tutors SA website, including lesson plans and materials, is protected by copyright laws.
Tutors or clients may not reproduce, distribute, or misuse Tutors SA content without permission.
17. Termination of Services
Tutors SA reserves the right to suspend or terminate a user’s access for breach of terms.
Tutors may terminate their accounts by notifying Tutors SA in writing with a minimum of one week lead time.
18. Governing Law and Jurisdiction
These terms and conditions shall be governed by the laws of South Africa.
Any disputes shall be resolved in the relevant courts of South Africa.
